TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLIOAIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless folioaide and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App or violation of these Terms.
We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violation of these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or through other reasonable means. Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
