End User License Agreement

This End User License Agreement is a legal agreement between you and folioaide governing your use of the folioaide mobile application. By downloading or using the App, you agree to be bound by this agreement.

Subject to the terms of this agreement, folioaide grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial purposes as permitted by the App Store Terms of Service.

You may not:

• Copy, modify, or distribute the App or any part thereof
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose
• Remove any proprietary notices or labels on the App
• Use the App in violation of any applicable law or regulation

The App is licensed, not sold, to you. folioaide and its licensors retain all rights, title, and interest in and to the App, including all intellectual property rights. These Terms do not grant you any rights to trademarks or service marks of folioaide.

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into this agreement. By using the App, you consent to our data practices as described in the Privacy Policy.

The App uses third-party services including Firebase for cloud storage and authentication, and financial data providers for market data. Your use of these services is subject to their respective terms and conditions. We are not responsible for the performance or conduct of these third-party services.

The App provides portfolio tracking and market information for informational purposes only. Nothing in the App constitutes financial advice, investment advice, or trading recommendations. Investing involves risk, including the possible loss of principal. You are solely responsible for your investment decisions.

The App is provided as-is and as-available without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of viruses.

To the fullest extent permitted by law, folioaide shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, even if folioaide has been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid for the App in the 12 months preceding the claim.

folioaide may update or modify the App at any time without notice. We may also update this agreement by posting a new version in the App. Your continued use of the App after any changes constitutes acceptance of the modified agreement.

This agreement is effective until terminated. Your rights under this agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

This agreement shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration, except where injunctive relief is sought for intellectual property matters.

This license is granted by folioaide, not Apple. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Apple is not responsible for any claims related to the App or your use thereof. Apple is a third-party beneficiary of this agreement and may enforce it against you.
